The Vilamalla City Council has begun imposing coercive fines on the logistics company Primafrio. The penalty is €3,000 every fifteen business days as long as the company continues to operate its logistics activity in an industrial zone of the municipality irregularly, after ignoring a cessation order issued months ago.
Mayor Albert Ramos explained that the main issue is that the sector's urbanization, which includes streets and lighting, has not yet been approved. According to Ramos, the construction of the warehouse has progressed faster than the urbanization of the necessary services.
The City Council initiated an urban planning disciplinary proceeding, deeming the works a serious infraction, with a proposed fine of €150,000 and the obligation to restore the altered land. Municipal reports advised against the activity's commencement, and despite a January cessation order and the subsequent dismissal of an appeal, the logistics activity has continued.
Given this situation, the Local Government Board agreed on May 20 to initiate the deterrent fines procedure. The company's latest submissions, made on July 6, have also been dismissed, and the case remains open.
Mayor Ramos asserts that the council has followed all administrative procedures rigorously and with legal guarantees, considering the case's complexity and the company's size. He also responded to criticisms from the environmental group IAEDEN-Empordà, stating that the group did not take into account municipal actions after February.
