The third section of the Audiència de Barcelona (Barcelona Court) decided to grant provisional release to Santi Laiglesa, the main suspect in the death of Helena Jubany, who had been imprisoned since November 28.

The magistrates of the Court consider "controversial" the issue concerning "the reliability or consistency" of the new DNA report that motivated the previous decision by the Sabadell judge to send him to prison.

The incrimination of the accused is neither irrational nor arbitrary.

Despite doubts about the genetic evidence, the chamber believes that the incrimination of the accused is "neither irrational nor arbitrary." However, they consider that the investigating judge did not sufficiently justify Laiglesa's risk of flight to keep him incarcerated.
Santi Laiglesa had entered provisional prison on November 28 by order of the Sabadell judge investigating the murder case of Helena Jubany, which occurred in 2001.
