The main objective of these measures is to defend the rights and interests of the Generalitat, as well as to guarantee the protection and legal assistance for its staff who have been affected by incidents while carrying out their duties.
This initiative is part of Law 7/1996, of July 5th, on the organization of the legal services of the Administration of the Generalitat de Catalunya. This law stipulates that the Generalitat's lawyers can act as private prosecutors in criminal cases where the Generalitat is harmed, pursuing the corresponding criminal and civil actions.
Furthermore, the possibility of acting as popular prosecution is foreseen when legally established grounds exist. To make this effective, the Government has tasked the Generalitat's Legal Office with carrying out all necessary actions, adhering to the requirements and authorizations set by current regulations.
