The association, led by Roger Pallarols, argues that these spaces contravene the food retail ordinance and constitute unfair competition for the restaurant sector. According to the Guild, this is the first such complaint in Spain against this business model.
Mercadona, for its part, has not made official statements but maintains that these areas are rest zones for customers, who are free to use them as they see fit.
“"You don't need a microwave to rest"
The Guild refutes the "rest zone" definition, asserting that the presence of microwaves indicates a dining function. Furthermore, they point out that regulations prohibit locating such areas between the checkout zone and the exit. Pallarols indicated that the complaint will be extended to other supermarkets.
Concurrently, the Guild has reported on the findings of a municipal inspection of 22 bakeries with tasting areas in the Eixample district, which revealed 57 infractions. Common violations include exceeding capacity limits and the prohibited sale of alcoholic beverages.
Pallarols criticized the Barcelona City Council's "irresponsible neglect," noting that despite confirmed infractions, no sanctioning procedures have been initiated, nor have any fines been imposed. The Guild is considering taking the matter to the public prosecutor's office.
