The fraudulent practice involves starting to count seniority only from the moment the employee obtains a permanent contract, ignoring years previously worked under temporary modalities or even the probation period. This omission can lead to the loss of significant economic benefits.
Benito illustrated the situation with a recent case where a client recovered four lost years of seniority, allowing her to add two additional triennials and 120 euros more to her monthly payroll. The lawyer advises reviewing the situation and deciding whether to claim immediately or wait for a potential dismissal to maximize compensation.
