The sentence finds the accused guilty of three offenses against moral integrity. In addition to the prison sentence, he is disqualified from exercising passive suffrage rights (standing as a candidate in electoral processes and being elected to public representative office) for the duration of the sentence. He will also have to compensate each parent with 3,000 euros and the minor with 1,000 euros for moral damages.
According to the judicial resolution, the convicted individual did not merely express an opinion but promoted "hostility," "isolation," "contempt," and "humiliation" towards the child and her family within the context of the linguistic conflict at the educational center.
The magistrates consider it particularly serious that he proposed school harassment as a solution to the conflict, suggesting that the minor be a victim of 'bullying' to make her leave the school. The court concludes that these actions violate fundamental rights such as dignity and moral integrity.
The message for which he has been convicted stated: "I'm sorry for the child, but they should bully her until she leaves." The court rules out that this constitutes a hate crime, considering that the victims were not attacked based on any of the specific legal grounds for this type of offense.
The judges also reject that freedom of expression can cover this behavior, understanding that the message exceeds the limits of criticism or opinion and constitutes an incitement to harassment against a minor.
This conviction is the second related to messages spread on social media during the linguistic conflict at the Canet de Mar school. In October 2025, the Barcelona Court of Appeal had already convicted another user for offenses of hate and against moral integrity.
