The court overturned a previous acquittal, sentencing F. J. R. Á. to a two-year professional ban and ordering him to pay 2,000 euros in compensation to the victims for the emotional distress caused by the incident.
The incident took place at a bar in Barcelona. According to the ruling, the waiter repeatedly refused to take their order and eventually told them to leave the premises, despite other customers being served normally on the terrace at the same time.

The judges emphasized that the principle of equality and non-discrimination must be upheld not only by business owners but also by their subordinates in any public-facing establishment.
