The Barcelona Court has sentenced a waiter's assistant for a crime against fundamental rights after he refused to serve a female couple due to their sexual orientation on October 5, 2022.

The court overturned a previous acquittal, sentencing F. J. R. Á. to a two-year professional ban and ordering him to pay 2,000 euros in compensation to the victims for the emotional distress caused by the incident.
The incident took place at a bar in Barcelona. According to the ruling, the waiter repeatedly refused to take their order and eventually told them to leave the premises, despite other customers being served normally on the terrace at the same time.
