COREMBE representatives, Consol Cordero and Josep Otero, have denounced a "lack of institutional rigor" in statements regarding the judicial resolution from the administrative litigation court number 2 of Tarragona, which allegedly supports the construction license for the monument's removal. Cordero clarified that the judicial order "only agrees to lift the suspension and continue the ordinary procedure," without delving into the merits of the case or declaring the license lawful.
The entity rejects the notion that lifting precautionary measures constitutes a "judicial victory" or "full validation of the license," considering it "a way to mislead the public" as "at this moment, the Tarragona court has not ruled in favor of anyone." COREMBE has attempted to open new legal avenues and is examining whether the Catalan democratic memory law can support the monument's situation, citing the possibility that "there are monuments, even if they are uncomfortable heritage, that due to their monumentality cannot be removed," referencing the Valley of the Fallen as an example.
Josep Otero has championed the outcome of the 2016 citizen consultation, urging the Tortosa City Council to "stop acting as if that consultation had never happened." COREMBE demands "historical rigor and a reinterpretation process led by historians, artists, and experts in democratic memory, not by partisan interests," aligning with the popular will voted on ten years ago.
Meanwhile, the Commission for the removal of Francoist symbols from Tortosa has welcomed the lifting of precautionary measures, calling for "swiftness" from the City Council and the Generalitat to execute the monument's removal. They emphasize the importance of eliminating symbolism that vindicates dictatorial regimes in the current context.
Sources from the Department of Justice and Democratic Quality are confident that the new democratic memory law, promoted by the Government, will allow for the management of the monument. They indicate that, with the judicial decision to lift the precautionary measures, "there are no longer impediments or other open cases preventing the resolution of the case's merits." Minister Ramon Espadaler has informed the mayor of Tortosa of the department's intention to work in alignment with the council.
