10 Million Euro Claim Withdrawn for Calafell Cinemas, But Main Lawsuit Continues

The company MCB, owner of the Calafell multi-screen cinemas, has withdrawn the 10 million euro claim against the councilors, although the owner maintains the judicial lawsuit citing a change in legal strategy.

The Calafell Town Council reported that the company owning the local multi-screen cinemas, MCB, has “desisted” from the 10 million euro patrimonial liability claim against the councilors who approved a key urban modification. This modification prevents the exhibition hall from being used as a commercial center and mandates the continuation of cinema activities.

The council, for its part, considers that the company's waiver of the claim “confirms that the municipal action was correct and adjusted to Law” and that the public interest was sought at all times to preserve a cultural activity. The Town Council maintains that it has saved the cinema offering in the municipality.
The owner, Joan Montserrat, maintains the main judicial action to be able to dedicate his building to the economic activity he deems appropriate, as commercial activity was what he could exercise before the urban modification. This change shifted the classification from commercial to private equipment, ruling out the establishment of a commercial area, for which Montserrat already had an agreement.
