Restorative justice offers a new path to resolve personal conflicts

A pilot restorative justice program in Barcelona has allowed individuals involved in traffic and electric scooter accidents to dialogue and understand the circumstances, offering an alternative to judicialization.

Mediation has become an effective tool to address the emotional and personal consequences of incidents such as traffic accidents or those involving electric scooters. This approach, which goes beyond simply assigning blame, allows the parties involved to better understand the facts and each other's motivations, facilitating conflict resolution.
One of the notable cases involved a driver and a motorcyclist who met months after an accident near the Sagrada Familia. Thanks to mediation, the motorcyclist was able to understand that the car's sudden braking was due to the unexpected presence of a tourist taking a selfie in the street. This encounter allowed both parties to express their experiences and bring emotional closure to the incident.

Another example was the mediation between a teenager and a ten-year-old child, accompanied by their mothers, following an electric scooter accident in the Hostafrancs neighborhood of Barcelona. The child's mother, who suffered the impact, expressed her need for the teenager to understand the consequences of his actions. During the mediation, it was revealed that the teenager had fled due to fear of legal implications, a fear shared by his mother, who was also an immigrant.

These mediations are part of a pilot program promoted by the Barcelona Bar Association (ICAB) and the Guàrdia Urbana. The lawyers involved emphasize the value of forgiveness and recognition in these processes, aspects often overlooked in traditional judicial procedures. The initiative seeks to consolidate and receive funding to expand, given the positive results obtained.
