The TSJC ruling, issued in January 2026, does not question the expropriation of the building, located on Mont d’Orsà street, but only the amount set as compensation for the former owners, the Pares Paüls religious congregation. The court found that the initial valuation did not reflect the reality of the property.
The use most adjusted to reality is that of a multi-family housing building, as concluded by the judicial expert, and not that of a single-family home, which was the valuation made by the Jury.
This correction in the categorization of the property's use directly affects the calculation methods (comparison and residual), which could result in a higher final cost for the Barcelona council. The annulled agreement had been adopted by the Expropriation Jury of Catalonia in 2022.
Following this new judicial setback, the City Council's legal services have requested clarification of the ruling from the judge. Casa Buenos Aires, formerly a nursing home, became a symbol of the neighborhood struggle in Vallvidrera since 2019 to prevent its conversion into a hotel and ensure its use for social housing.
