The private prosecution, exercised by the victim's mother, is requesting the maximum penalty of one to six years of confinement for the young man who severely hit the child in Avià on August 31, 2024. Since the driver was 17 years old at the time of the accident, the case is judged under juvenile criminal responsibility legislation, and the sentence, if applicable, would be served in specific centers.
The lawyer for the private prosecution, Javier Leiva, has indicated that no compliance agreement is expected at Wednesday's hearing, which will force the court to set a trial date.
The compliance hearing is held this Wednesday morning at the Juvenile Court number 4 in Barcelona, on the Gran Via de les Corts Catalanes, to attempt to reach an agreement before setting the trial date. The child, who was 9 years old at the time of the incident, was hospitalized for over a year and, 16 months after the accident, continues to suffer severe consequences.
The hit-and-run occurred at a quarter to eleven at night, in a zone limited to 30 km/h, when a speeding car struck the minor. The swift intervention of three doctors and two nurses present at the scene was crucial to resuscitate the victim, who suffered cardiorespiratory arrest. The driver, a resident of Sagàs, fled but was arrested thanks to the collaboration of a neighbor who pursued the vehicle and identified the license plate, allowing the Mossos d'Esquadra to find the car in Cal Rosal.
The young man was arrested for serious reckless injury, reckless driving, and driving without a license. Although the Prosecutor's Office initially requested precautionary internment, the judge decreed supervised release with therapeutic intervention. However, both the Prosecutor's Office and the victim's family appealed to the Audiencia de Barcelona to request admission to a juvenile center, arguing the severity of the facts and that the driver allegedly drove again without a license after the tragic accident.
