The oral hearing took place this Thursday in the criminal section of the Audiència de Girona. According to the victim, a resident of Sant Hilari Sacalm (la Selva), the assault occurred when she had gone to the defendant's house in Berga to collect clothes, shortly after the relationship had ended.

The woman testified before the court that, after going to sleep, she woke up when the accused was touching her. Although she clearly stated that she did not want to have sexual relations, the defendant ignored her refusal and proceeded with the rape.

The accused, however, denies the allegations. Responding to questions from the defense, he admitted to making advances with the intention of having sex, but claims that when she refused, they argued, and he stopped. The defense is requesting the full acquittal of their client.
