L'Espluga de Francolí Town Council ordered to pay for unfair dismissal

The court mandates the local government to reinstate the former Tourism manager or pay him compensation of nearly 60,000 euros.

The Social Court of Tarragona has ruled the dismissal of the former L'Espluga de Francolí Tourism manager unfair, compelling the Town Council to reinstate him or pay an indemnity of 59,638.49 euros following the decision made in September 2023.

The ruling issued by the Tarragona court establishes that the local government in Conca de Barberà failed to prove a real organizational or economic cause justifying the objective dismissal of the employee, carried out on September 28, 2023.

The substitution of his position for a higher-level post responds to a mere convenience and not an objective necessity.

The L'Espluga de Francolí Town Council had alleged the dismissal after incorporating a new senior technician position for Tourism and History A1 and dissolving the Tourism Board, the body the former manager headed.
The judge argues that the essential functions performed by the worker—administrative and economic management, and tourism coordination—remain necessary and are not directly linked to the new position, which focuses on the archaeological and museum field.
