TSJC upholds dismissal of bank director for snooping on client data

The ruling confirms CaixaBank's decision after the employee unjustifiably accessed the information of 170 people, including relatives and acquaintances.

The High Court of Justice of Catalonia (TSJC) upheld the dismissal of a former CaixaBank director in Les Preses (Girona) in June 2025 for improperly accessing the personal data of approximately 170 clients.

The TSJC ruling dismisses the appeal filed by the worker and confirms the previous sentence from a Figueres court, issued in July 2024, which had already declared the dismissal valid. The financial institution initiated the process after an internal audit detected "irregularities" in the data consultations.
The audit revealed that the employee had accessed the information of 170 clients, many of whom did not belong to her branch, without any professional justification. The plaintiff herself admitted during the process that the motivation behind these consultations was simply to "gossip".

The sentence emphasizes that there was no authorization or connection to legitimate operations on the affected clients' accounts. Of the 170 clients consulted, 84 were family members or people in her personal circle, and 38 were related to the former.
Furthermore, 121 of the affected individuals resided in Sant Feliu de Pallerols, the worker's municipality of residence, reinforcing the conclusion that the consultations were driven by personal, not professional, interest.
