ATA wins five legal battles against Girona town councils over tourist rentals

Courts annul restrictive regulations and specific waste taxes in several municipalities across the province.

The Tourist Apartment Association (ATA) has secured five favorable court rulings against various town councils in Girona regarding regulations and taxes imposed on tourist use dwellings (HUT).

In Begur, the court declared the POUM modification null, removing the requirement for extra parking spaces for tourist flats. Meanwhile, in Tossa de Mar, the TSJC partially upheld a challenge against the local housing plan, striking down articles related to prior communication regimes.
Tax disputes were also resolved in favor of the ATA in Cadaqués, Sant Pere Pescador, and Llívia. Judges ruled against specific increases in waste collection fees that targeted tourist rentals, declaring these fiscal modifications void.
The association has announced further legal actions in Girona and Lloret de Mar. They are currently challenging urban planning modifications and fiscal ordinances, vowing to continue fighting measures they deem disproportionate for the sector.
