The Girona Court has acquitted a man who faced a 10-year prison sentence for the alleged sexual abuse of a minor in la Bisbal d'Empordà in May 2021.

The court ruled that there was insufficient evidence to overturn the presumption of innocence. The incident allegedly took place during a birthday party at a local skatepark, but medical exams showed no injuries and no genetic profile of the accused was found.
Witnesses present at the scene also contradicted the victim's account, stating they did not observe any assault. Furthermore, a photograph showing the accuser and the defendant together at a later date undermined the claims of intimidation presented during the trial.
While the defendant was cleared of the abuse charges, the court has ordered an investigation into a potential breach of a restraining order that was active at the time the photograph was taken.
