The sentence, initially issued by the Provincial Court of Tarragona, imposes this penalty on two men accused of severely assaulting another person with numerous blows and nine stab wounds. In addition to the prison sentence, a restraining order and five years of supervised release have been established for the convicts.
Previously, the High Court of Justice of Catalonia (TSJCat) had already dismissed the appeal filed by the two defendants, maintaining the initial ruling.
The events took place in the early hours of April 25, 2023, in a restaurant located on the N-240 road. After an initial argument with a couple, the accused left the premises. Half an hour later, a group of people, including the convicted individuals, returned to the scene and assaulted the victim, who was on the terrace of the already closed establishment.
During the assault, the victim received multiple blows and nine stab wounds to the chest, causing life-threatening injuries. They were transferred to Joan XXIII Hospital, where they required admission to the ICU and emergency surgery. The injuries took 24 days to heal.
In the appeal to the Supreme Court, the convicted individuals did not dispute the facts but rather the application of the mitigating circumstance for damage repair, arguing that the deposit of 7,372 euros before the trial should have led to a greater reduction in the sentence. However, the High Court did not accept this interpretation.
