The Third Criminal Section of the Audiencia Nacional agreed to release Alcívar Bautista, known as “Comandante Willy”, after the three-month deadline granted to Ecuador expired. Ecuadorian authorities were required to effectively guarantee the right to life and personal integrity of the claimant, given the high level of violence in the country's prisons.
The 36-year-old criminal leader faced two extradition processes in Spain. The first was related to his alleged involvement in the assault on a television channel in Guayaquil while broadcasting live on January 9, 2024. The second was for alleged extortion of a citizen who was demanded $20,000 under threat of attacking his family.
The Spanish court justified the requirement for these guarantees on the need to ensure that Ecuador adopted concrete measures, in line with the recommendations of the Inter-American Commission on Human Rights, to protect the fundamental rights of inmates.
Alcívar Bautista was arrested on October 23, 2024, in Segur de Calafell, alongside his brother, Álex Iván, alias “Ronco,” in a joint operation by the Guardia Civil and the Ecuadorian Police. The criminal organization Los Tiguerones is also linked to the murder of Ecuadorian prosecutor César Suárez, who was shot days after starting the investigation into the TV channel assault.
