The judicial resolution, issued by the fourth section of the Tarragona Court, decreed the free dismissal of the case against Salvadó, president of the ERC Regional Federation of Terres de l’Ebre, and Caparrós, former mayor of La Ràpita. Both were awaiting trial for the alleged crimes of disobedience and administrative prevarication.
According to an ERC statement, the resolution declares “the actions attributed to the two municipal officials totally amnestied, extinguishes any criminal and civil liability, and nullifies all precautionary measures.” The court concluded that the events fall within the framework of the political and institutional process linked to 1-O and are covered by the Organic Law 1/2024 on Amnesty.
“"It is a victory for democracy over repression. This ruling confirms what we have always defended: that we were persecuted for putting institutions at the service of democracy and popular will."
Salvadó added that they had lived for years “under a criminal case that should never have existed.” For his part, Josep Caparrós, currently manager of COPATE, noted that justice “arrives late, but it arrives” and defended his actions.
“"We never acted out of personal interest or outside of our commitment to the citizenry, but with democratic convictions."
The two amnestied individuals agreed that the amnesty “does not erase the suffering or the years of personal and family pressure,” but it does open the door to a new scenario based on dialogue and respect for democratic will. They showed support for colleagues still awaiting the law's application, such as ERC President Oriol Junqueras, or Lluís Salvadó.
