The expulsion of Xavier Tobias, who now serves as a non-attached councilor in the opposition, was formalized last December. The governing team of Més Boadella i les Escaules-AM justified the decision by accusing Tobias of having acted “unilaterally, without any municipal authorization or agreement,” attempting to access a previously boarded-up private property in Les Escaules so that a friend could occupy the dwelling.
For his part, Tobias strongly denies the allegations. He maintains that his sole intention was to inspect the property, which was in a state of abandonment, and that he had previously communicated his action. Furthermore, he attributes his removal from the government to accumulated political discrepancies, such as his opposition to expropriating land near councilor Elisabet Llorente's house to create a parking lot.

Socialist councilor Jesús Ramió, also in the opposition, has publicly defended Tobias, arguing that the action was “entirely proportionate” given the property's state of “evident and absolute abandonment.” Ramió added that the objective was to verify if any irregular activity was taking place and denied that the mayor's office had prohibited access.
The Mayor, Jaume Jan, countered that since the expulsion, Tobias has submitted written requests “repeatedly and daily” regarding various municipal activities, causing a “significant overload” and the collapse of administrative services. However, Ramió points out that most of Tobias's requests concern files he directly collaborated on while he was part of the governing team.
