Catalan Parliament approves regulation of seasonal and room rentals to prevent housing law fraud

The new legislation subjects non-touristic temporary leases to standard housing rules to cap prices in stressed market areas.

The Catalan Parliament approved this Thursday the regulation of seasonal and room rental contracts to curb the circumvention of price limits in areas designated as stressed housing markets.

The measure, which aims to restrict the concept of seasonal rental only to "recreational, holiday, and tourist uses," received support from the PSC, ERC, Comuns, and the CUP, while Junts, the PP, Vox, and Aliança Catalana voted against it. Other temporary contracts (for studies, professional, or medical reasons) are now subject to standard housing regulations, including price limits.

Regarding room rentals, the law prevents the sum of individual prices from exceeding the total limit set for the entire flat, thus preventing owners from dividing the property to increase profits. This regulation follows data from the first half of 2025 showing a 52% increase in seasonal contracts, indicating regulatory evasion.

The new regulation also strengthens the sanctioning regime, with fines reaching up to 900,000 euros for non-compliance, and declares inspectors as agents of authority. Furthermore, a registry of large holders is created, and deposits held by the Institut Català del Sòl (Incasòl) will be allocated to the construction of protected housing.
