The trial, taking place at the Fourth Section of the Audiencia de Girona, started this Friday with the selection of the popular jury. The prosecutor is seeking a sentence of 19 years in prison for intentional homicide (dolus eventualis) and a public health offense. The prosecution argues that the reckless escape was not a mistake but a deliberate attempt to avoid capture, as he was carrying 15.29 kilos of marijuana and 1.32 kilos of hashish.
The investigated person, when reversing direction on the lane, must have considered a fatal head-on collision probable, given the speeds on the motorway.
The events date back to June 10, 2023, when the driver, a 22-year-old French national, detected the presence of the French National Police on the A9 near the border. He made a U-turn and began driving against traffic on the AP-7 near La Jonquera.
During the pursuit, the vehicle collided head-on with another car driving correctly. The driver of that vehicle, a 61-year-old Polish man, died instantly. The accused suffered minor injuries. The confiscated drugs, weighing over 16 kilos, were valued at 32,491.8 euros on the illicit market.
In addition to the prison sentence, the prosecutor requests 400,000 euros in compensation for moral damages for the victim's family. The trial is expected to conclude next Thursday, with the accused scheduled to testify on Wednesday morning.
