Supreme Court clears the way to remove Francoist monument in Tortosa

The high court rejects an appeal from a pro-Franco group, confirming the legality of the monument's removal.

The Supreme Court has rejected an appeal by the Asociación Cultural Despierta España, effectively allowing the removal of the Francoist monument in Tortosa to proceed in 2026.

The ruling, dated January 14, 2026, ends the legal battle over the monolith that honors the fascist side of the Battle of the Ebro. The court found that the appeal lacked legal grounds and failed to meet the requirements for a review of the previous TSJC sentence.
The legal dispute focused on the Tortosa city council's decision to change local urban planning regulations in 2020 to remove the monument's protected status. This move was part of the application of the Historical Memory Law in Catalonia.

The court also ordered the association to pay legal costs of up to 2,000 euros to the Generalitat de Catalunya. The monument is currently nearing its 60th anniversary since its inauguration during the dictatorship.
