The reform, approved with the votes of the PSC, ERC, Comuns, and the CUP, aims to eliminate the economic incentives that had fueled the growth of seasonal and room rentals, often used to bypass price regulation. Junts voted in favor of the main body of the law but against key aspects such as seasonal rentals and the 50% reservation of subsidized housing.
Under the new regulation, all rental contracts formalized —except for tourist, holiday, or recreational uses— will be regulated by the same law, regardless of their duration. This means the price cap, set by the state reference index and in force since March 2024, will apply to large holders (five or more properties) or first-time rentals. Seasonal contracts for professional, labor, or medical reasons are still permitted but must meet the same guarantees as habitual residence contracts, and their purpose must be justified and registered with Incasòl.

The seasonal rental modality had experienced massive growth, particularly in Barcelona. According to Idealista data, nearly half of the rentals advertised in the Catalan capital are now seasonal, up from 28% two years ago. Regarding room rentals, the law limits prices: the sum of individual rents cannot exceed the limit set by the index for the entire flat. This measure deals a severe blow to the coliving business model, which had purchased entire buildings in neighborhoods like Gràcia and the Eixample to triple rental income.

The reform also includes the creation of a registry for large holders, managed by the Agència de l'Habitatge de Catalunya, and a Supervision Commission for Housing Lease Contracts to strengthen inspections. Although the Sindicat de Llogateres (Tenants Union) welcomes the measure, it insists on the need for exemplary sanctions. Conversely, the College of Real Estate Agents (API) warns that the rule could create legal uncertainty and be subject to an appeal of unconstitutionality, as happened with the previous rent regulation in 2020.
