The course pursues a very specific objective: to provide attendees with the theoretical and practical tools necessary to competently handle any civil liability and insurance matter, from the initial assessment of the claim to its judicial or extrajudicial resolution. It is aimed at practicing lawyers, insurance company professionals, and insurance brokers.
The program is structured into four blocks that replicate the real itinerary of a case file: the fundamentals of civil liability; the insurance contract (elements, limiting and delimiting clauses, obligations of the parties, default under art. 20 LCS, and frequent conflicts); types of civil liability by sector —traffic and the Scale of Damages, corporate, health, professional, construction, derived from crime, transport, public administration liability, minors, and new digital risks and AI—; and, to conclude, the assessment of damages and claims strategy, from the extrajudicial route and Alternative Dispute Resolution (ADR) to the judicial forum, with special attention to expert evidence.
The faculty combines practicing lawyers from both sides of the table with the magistrate of the Social Chamber of the High Court of Justice of Madrid, Raquel Vicente Andrés, the professor of Commercial Law at the UAB, Eliseo Sierra Noguera, and legal managers of insurance companies. Classes will be taught in Catalan or Spanish, according to academic freedom, and the chosen modality must be maintained throughout the course.
