Generalitat Opens Over 500 Files for Rental Non-Compliance

The Generalitat has initiated 529 sanctioning files in strained rental areas since the rental price limitation law came into force, with most cases in the Barcelona region.

The inspection unit of the Department of Territory, Housing and Ecological Transition has opened a total of 529 sanctioning files in areas declared as strained rental markets. This action follows the implementation of regulations that set a limit on rental prices.
Of the total files, 74% were initiated ex officio by the inspection unit itself, while the remaining 26% were activated due to complaints filed by individuals. Currently, 89% of the files are in the preliminary investigation phase, which corresponds to the initial investigation of the reported facts. In seven cases, the sanctioning file has already been formally opened.

The main reason for these files, present in 79% of cases, is exceeding the maximum rent amount established for the area. Other infringements include the undue passing on of real estate management or contract formalization expenses to the tenant, as well as the lack of proper declaration of being a large landlord or the price.
Ten percent of the files, specifically 51, have been archived, either during the preliminary investigation phase (18) or definitively (31). The most frequent reason for archiving individual complaints is that the lease agreement predated the entry into force of the law, and therefore, was not subject to the new regulations.
The Barcelona demarcation concentrates the majority of the files, with 402 cases (76% of the total), followed by Tarragona with 60 (11.3%), Girona with 48 (9%), and Lleida with 19 (4%). At the municipal level, the Catalan capital, Barcelona, accounts for 210 files, representing 40% of the total. Also notable are Girona with 31, Badalona with 23, and Sitges with 14.
In collaboration with the Barcelona City Council, 17 inspections were carried out in 11 locations in the city on April 15, with the support of the Guàrdia Urbana. This operation detected 12 dwellings with possible non-compliance, mainly flats intended for room rentals, and investigations into these properties remain open.
