President of Cerdanya Regional Council Testifies Over Illegal Construction

The testimony before the judge in Puigcerdà is part of an investigation into a building in a protected, flood-prone area in Fontanals de Cerdanya.

The president of the Cerdanya Regional Council and mayor of Bolvir appeared this Monday before the judge in Puigcerdà concerning an alleged illegal construction on land in Fontanals de Cerdanya, located in a protected and flood-prone zone.

The investigation focuses on a building near the village of Queixans, in the municipality of Fontanals de Cerdanya. The accusation, brought by the SOS Pirineus entity, alleged that the construction is situated in a protected and flood-risk area.
During the day, several technicians who prepared reports on the investigated building also testified. These included an expert proposed by the defense, another person summoned by the judge, and a municipal architect called by the prosecution. All of them referred to the statements they had previously submitted to the Prosecutor's Office.

"The president of the Regional Council had to acknowledge, when questioned by the judge, that he was the owner of the property at the time illegalities constituting a crime occurred, and therefore, in our opinion, the criminal responsibility remains at the same point it was before this declaration."

The environmental organization's lawyer added that the acknowledgment of the construction of a swimming pool and a small house, as well as a possible residential authorization in a flood-prone area, could not be ruled out by the technicians. This situation, from their perspective, could directly lead to a trial to clarify responsibilities.

"I believe it is important for justice to convey the message that before urban legality, we are all equal; there are no differences, and in this sense, political positions or relationships with institutions of certain individuals cannot result in preferential treatment, especially in urban planning matters."

The lawyer regretted that the president of the Regional Council used a significant part of his testimony to "attack the environmental entity and the work it carries out in the region." He indicated that the investigation has been extended and further proceedings could be carried out, although all those under investigation have already testified and the parties have proposed the necessary reports. For all these reasons, he expressed optimism regarding the opening of an oral trial.
For their part, neither the president of the Cerdanya Regional Council nor any representative of the accused party offered statements to the media to provide their version of events.
