The court dismissed an appeal filed by a victim's family, ruling that there is insufficient evidence to proceed with criminal charges. The case, which lasted five years, investigated the circumstances surrounding the deaths of seven residents at a facility managed by the Suara cooperative.
Judges upheld a previous ruling from the Olot court, noting that reports from the Mossos d'Esquadra police force could not prove the employee was the sole source of the infection. Furthermore, the worker had tested negative in a PCR test conducted by the center during the period in question.

The defense argued that the worker's symptoms were consistent with a chronic cough she had suffered for over a year. This legal victory follows a separate labor court ruling in Girona which had already declared her dismissal from the nursing home as unfair.
