The legal action, presented by lawyer Benet Salellas, seeks constitutional protection after the Spanish justice system refused to investigate the actions of the National Police agent. The agent adopted a false identity to infiltrate the pro-independence and social movement in Girona, establishing a romantic and cohabiting relationship with Campos to gain access to sensitive information.
“"Infiltrating police agents into a democratic and peaceful movement without the slightest indication of a crime is already aberrant in itself, but for the justice system to refuse to investigate it is intolerable."
The plaintiffs, including the Associació Ateneu Popular de Girona and the Associació No al Racisme de Girona i Salt, argue that agent Isern "objectified" Campos, turning him into a mere instrument for espionage. They assert that using intimate relationships for infiltration constitutes a "form of violence and abuse" incompatible with the standards of a democratic state.
The dismissal of the lawsuit was confirmed by the Audiència Provincial de Girona on December 16, which ruled that the relationship was "consented" and that the agent merely "omitted" her true identity. The appealing entities criticize that the ruling "holds the victim responsible for having suffered the reported damages" and arbitrarily presumes the justification of the mission without any investigation being conducted.
