The ruling establishes shared responsibility between the victim and the company, as the circuit lacked adequate safety barriers. This deficiency was a determining factor in the severity of the accident, according to the judicial resolution.
The accident occurred on March 28, 2016, when the 44-year-old victim was driving his own kart. A brake failure caused him to leave the track perimeter and collide with a concrete wall. The man was taken to the hospital with serious injuries and died on April 2 of the same year.

Although the criminal case was closed in 2018, the civil case determined that the primary cause of the accident was a mechanical defect in the kart's braking system, attributable to the driver for poor maintenance of his vehicle. However, the court of first instance number 8 of Lleida found contributory negligence, assigning 55% responsibility to the victim and 45% to the circuit operating company.
The Court has dismissed the appeal filed by the company and maintained the criterion of contributory negligence. Furthermore, it has modified the compensation amounts, considering that the 12,000 euros received by the widow for personal accident insurance should not be deducted from the civil liability compensation. Finally, compensation of 145,500 euros has been established for the widow and son. This resolution is not final and can be appealed before the Supreme Court.
