The ruling is based on the doctrine established by the Supreme Court less than a year ago, which dictates that banks must assume responsibility for fraudulent operations resulting from identity theft, even if the client's credentials were used.
The specific case of the Lleida resident began when he was contacted via WhatsApp by someone impersonating a bank employee, who convinced him his account access was blocked. Subsequently, another supposed employee sent him a link to enter his code.
The ruling highlights the “technological vulnerability” of the plaintiff, who is an elderly person to whom “it is difficult to understand certain processes.”
This deception resulted in two unauthorized charges totaling 8,600 euros stolen from his savings. The second charge occurred even after the client had already notified the bank about the first fraudulent transaction.
