FuneCamp appeals court ruling to TSJC, insists project is 'legal and viable'

The supramunicipal public company is challenging the judicial decision that annulled its founding agreements following a private sector lawsuit.

The public supramunicipal company FuneCamp announced its appeal to the TSJC against the ruling issued by the Tarragona Administrative Court on February 9, which annulled its constitution.

FuneCamp, the public supramunicipal company promoted by the municipalities of Reus, Salou, Vila-seca, and Constantí, maintains that its project is "legal and viable" and will continue working "with responsibility, rigor, and absolute respect for legality." This statement follows the judicial resolution that upheld the appeal filed by private operators Mémora, FuneConca, and Serveis Funeraris Pedrola Montbrió.

The court ruling annulled the plenary agreements of the promoting municipalities, deeming them "contrary to law," and ordered them to pay the legal costs. FuneCamp, while stressing its respect for judicial decisions, argues that the non-final sentence "does not adequately reflect either the reality of the project or the legal framework that protects it." Consequently, it will file an appeal with the High Court of Justice of Catalonia (TSJC).
The core of the ruling focuses on the justifying memorandum approved in the plenary sessions. The magistrate concluded that the document failed to provide the necessary information to confirm the financial sustainability, budgetary stability, necessity, and opportunity of the project. Private companies claim that establishing FuneCamp as an "in-house provider" violates regulations and distorts free competition, potentially concentrating up to 98% of the market share.
