Pioneering Proposal in Tarragona to Expel Repeat Offenders

An unprecedented initiative in Catalonia seeks to allow the Tarragona City Council to act as a prosecuting party in theft cases to combat repeat offenses.

A proposal by Junts per Tarragona suggests that the Tarragona City Council act as a prosecuting party in criminal proceedings for theft, aiming to expel repeat offenders from the city, an unprecedented initiative in Catalonia.

The political party Junts per Tarragona has put forward an initiative that would allow the Tarragona council to directly address repeat offenses. This proposal is based on the application of Organic Law 1/2026, which amends the Criminal Procedure Law and grants local entities the legitimacy to exercise criminal action in theft offenses.

According to the regulations, this measure could be activated by a mayoral decree. Article 105.3 of the LECrim, stemming from the recent repeat offense law, allows city councils to “exercise criminal action for theft offenses” provided for in the Penal Code, granting them autonomy from the Public Prosecutor's Office to act as a prosecuting party.
The document, titled Expelling Criminals from Our Neighborhoods, includes an operational plan with eight measures. These include a mayoral resolution to activate municipal criminal legitimacy, the approval of a plenary agreement for support, and the establishment of a coordination protocol with police forces, as well as a system for case monitoring and recidivism registration.

The proposal aims to provide a “useful response to Tarragona residents,” moving away from extremism and with the goal of combating crime and increasing order and safety in the streets. For its implementation, a legal report from the General Secretariat of the City Council on the viability and requirements for exercising municipal criminal action is needed.
The party is confident that the governing team will vote in favor of the motion to be presented this Friday. The benefits of acting as a prosecuting party in these criminal cases include the defense of citizens' interests by the council, with the aim of ensuring that criminals are convicted and expelled from the city. The repeat offense law is already in force, allowing for immediate application of the measure.
Sources from the PSC have confirmed that they will vote in favor of Junts' proposal in the plenary session scheduled for this Friday.
