The Fourth Section of the Tarragona Provincial Court has applied the Amnesty Law to ERC Deputy Albert Salvadó and former La Ràpita mayor Josep Caparrós for actions related to the October 1, 2017, referendum.

The judicial resolution, issued by the fourth section, decrees the free dismissal of the case that kept Salvadó and Caparrós pending trial for alleged crimes of disobedience and administrative prevarication.
The court concludes that the facts fall fully within the framework of the political and institutional process linked to 1-O and, therefore, are covered by Organic Law 1/2024 on Amnesty, extinguishing any criminal and civil liability.

"This ruling confirms what we have always defended: that we were persecuted for putting institutions at the service of democracy and popular will."

For his part, Josep Caparrós stressed that they never acted out of personal interest, but with democratic convictions, although he believes that “justice arrives late, but it arrives”.
This resolution closes a judicial procedure initiated more than eight years ago and adds to other recent applications of the law that highlight the need to dejudicialize the political conflict between Catalonia and the State.
