The judicial decision comes just days after the Court of Justice of the European Union (CJEU) upheld the compatibility of the law with community law. Although the Supreme Court does not directly cite the European ruling, the move occurs in a context marked by demands to apply the law within a specific timeframe.
Among the beneficiaries of the measure is the former mayor of Sabadell, who had previously been sentenced to disqualification and a fine for his actions during the October 1, 2017, referendum. The ruling puts an end to the judicial proceedings that were still open for him.
The resolution also affects several former members of the Parliament Bureau and three individuals convicted for the protests in October 2019. In all cases, the criminal chamber has declared the acts amnestied, rendering the pending appeals from the prosecution and the defense void.
