Catalan Parliament approves law to regulate seasonal rentals and limit prices

The new regulation links temporary leases to special plans and establishes price caps for residential uses in tense housing market areas.

The Catalan Parliament approved a pioneering law on December 18, 2025, to regulate seasonal rentals, aiming to prevent the circumvention of price caps in tense residential market areas.

The initiative received support from the PSC, ERC, the Comuns, and the CUP, while Junts voted in favor of some articles but rejected the core of the regulation. The approval followed the validation of most of the text by the Consell de Garanties Estatutàries, which led to amendments preventing the automatic expiration of public housing extensions.
The core of the new regulation is based on the purpose of the rental. If the use is residential, regardless of duration (e.g., a six-month training course), the price cap will apply, as Barcelona is classified as a tense zone. Tourist use rentals are excluded from this specific price limitation.

The law also regulates room rentals, stipulating that the sum of individual room prices cannot exceed the established cap for the entire apartment. To ensure compliance, the figure of the inspector is created, responsible for monitoring the actual use of the housing, detecting fraud, and imposing penalties.
The Barcelona City Council, through its mayor, announced that it will apply the new regulation immediately upon its entry into force. Although the Generalitat holds the competence, the mayor urged the regional government to “be very precise with inspection and sanctions” to combat irregularities.
