Laietània school in Badalona ordered to compensate student for bullying

The Court of First Instance number 6 of Badalona has condemned the Laietània school to pay €12,000 to a student who suffered continuous bullying for over a year due to the center's lack of diligence.

The ruling considers it proven that the minor was a victim of repeated humiliations, vexations, and physical aggressions, including insults like “anorexic” or “outcast”. This dynamic continued for months without the Laietània school adopting effective measures to stop it, to the extent that the student had to stop attending classes to protect her mental health.

The judge considers the amount of compensation to be “even moderate,” taking into account the duration and severity of the events, and the psychological suffering the minor had to endure.

During the trial, the educational center denied responsibility, arguing that the first incident, which occurred on February 5, 2021, had taken place outside school premises. The sentence, however, is forceful and attributes responsibility to the school, which is criticized for refusing to prepare a report on the bullying.
The judicial resolution emphasizes that educators were aware of the situation since February, but it was not until July that the case began to be studied. The ruling also criticizes that the bullying continued into the following school year and that the psychologist from the Psychopedagogical Assessment and Guidance Team never attended to the minor.
The center's inaction led to a case of school absenteeism. Given the lack of response, the family turned to the Síndic de Greuges (Catalan Ombudsman), which revealed that a bullying protocol had been activated in April, which erroneously concluded that no case of bullying existed. The sentence is not final and can be appealed.
