Court ruling invalidates protection of Ca l’Espardenyer in Monistrol de Calders

The resolution determines that the urban planning modification made by the previous CUP government was incorrect, opening the door to demolition.

A court ruling has invalidated the protection status of the Ca l’Espardenyer house in Monistrol de Calders, forcing the city council, led by Mayor Arturo Argelaguer, to call a binding referendum to decide its future before the end of the year.

The judicial resolution, which is not yet final, dictates that the urban planning modification that granted Ca l’Espardenyer the status of Local Cultural Interest Asset (BCIL) was carried out incorrectly during the last legislature, under the CUP government. According to Mayor Arturo Argelaguer, the house now reverts to the 1992 planning, which designates the space as a road, and recovering it as a municipal facility would require a new specific modification.

Argelaguer recalled that when the modification was approved, he was the head of the opposition and already warned of the speed and possible irregularities in the process, which included alleged favors to a neighbor. After years of litigation, the council has lost the judicial battle. Now, the mayor maintains his promise to transfer the final decision to the citizens through a popular consultation.
The council is working with a company and the Consell Comarcal (County Council) to prepare the consultation, which is expected to be held before the end of the year. Argelaguer stressed that the consultation will be legally binding and the question will be simple: whether the neighbors want to keep the house standing or not. The mayor has avoided taking a position, fulfilling his electoral commitment to leave the decision in the hands of the people.
